Privacy Policy

AXON TMS ("AXON," "we," "our," or "us") provides transportation management software to asset-based carriers, freight brokers, and container freight station warehouses. This Privacy Policy explains how we collect, use, share, and protect personal information in connection with our website at axon-tms.com, our hosted application, and our SMS messaging program (collectively, the "Services").

1. Introduction

AXON provides our Services to business customers ("Customers") such as carriers and brokers. Our Customers determine what personal information about their employees, drivers, and counterparties is processed through the Services. AXON acts as a data processor for that information on behalf of our Customers. AXON also collects information directly from visitors to our website and from Customers who subscribe to the Services.

2. Information We Collect

Depending on how you interact with us, we may collect the following categories of information:

  • Account information: name, email address, phone number, company name, role, and password.
  • Driver and operational information: driver names, mobile phone numbers, license details, equipment assignments, and load assignments, provided by our Customers.
  • Location information: when a driver consents through AXON Track, we receive their device location during an active tracking session.
  • SMS information: mobile phone numbers used in our SMS program and the content of messages sent or received through the program.
  • Usage information: log data, IP address, browser type, operating system, pages viewed, and timestamps when you use the Services.
  • Cookies and similar technologies: we use cookies to authenticate sessions, remember preferences, and measure usage.

3. How We Use Information

We use personal information to:

  • Provide, operate, and maintain the Services on behalf of our Customers.
  • Authenticate users and secure accounts.
  • Send transactional and operational messages, including SMS related to driver location coordination.
  • Respond to inquiries and provide customer support.
  • Comply with legal obligations and enforce our agreements.
  • Detect, prevent, and address fraud, security, or technical issues.
  • Improve and develop new features of the Services.

4. SMS Communications

AXON operates a transactional SMS program known as AXON Track for the purpose of coordinating driver location updates with dispatch operations. This section describes how that program works.

Opt-In

Drivers are enrolled in the SMS program by their employing carrier or broker as part of standard job onboarding. The carrier maintains a record of each driver's consent to receive operational SMS at the mobile phone number on file. By providing a mobile phone number, the driver agrees to receive operational SMS messages from AXON related to their dispatched loads.

Message Type and Frequency

Messages sent through AXON Track are transactional and operational only. They are not marketing or promotional messages. Frequency varies based on load activity. A driver typically receives one to two messages per assigned load.

Opt-Out

Drivers may opt out of the SMS program at any time by replying STOP to any message received. Upon receiving a STOP request, we will send one final confirmation message and will not send further SMS messages to that number. Drivers may resubscribe at any time by replying START.

Help

Drivers may reply HELPto any message to receive contact information for their carrier's dispatch team and for AXON TMS support.

Carrier Charges

Message and data rates may apply, depending on the driver's mobile plan. AXON is not responsible for any charges imposed by mobile carriers.

Sharing of Mobile Information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

Information we collect through the SMS program (including mobile phone numbers and message content) is used solely to operate the AXON Track service for the driver's carrier. We do not sell or rent this information to anyone.

5. Sharing of Information

We share personal information only in the limited circumstances described below:

  • With our Customers. Driver and operational information is shared with the carrier or broker who employs or contracts with the driver, to operate dispatch and tracking services.
  • With service providers. We use third-party providers for cloud hosting, database services, SMS delivery, email delivery, error monitoring, and analytics. These providers process information on our behalf and are bound by contractual obligations to keep it confidential and use it only for the purposes we direct.
  • For legal reasons. We may disclose information when required by law, regulation, legal process, or governmental request, or to protect the rights, property, or safety of AXON, our Customers, or others.
  • With your consent. We may share information with third parties when you direct us to do so.

We do not sell personal information.We do not share personal information with third parties for those parties' own advertising or marketing purposes.

6. Data Security

AXON uses industry-standard technical and organizational measures to protect personal information, including encryption in transit (TLS 1.2 or higher), encryption at rest, AES-256-GCM encryption for stored integration credentials, role-based access controls, and per-tenant data isolation in our multi-tenant architecture. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.

7. Data Retention

We retain personal information for as long as necessary to provide the Services, comply with our legal obligations, resolve disputes, and enforce our agreements. Driver location ping data collected through AXON Track is retained for the duration required to support dispatch operations and is deleted or anonymized thereafter according to the configuration agreed with each Customer.

8. Your Rights

Depending on your jurisdiction, you may have the right to access, correct, delete, or restrict the processing of your personal information, and to data portability. To exercise these rights, contact us using the information below. If you are a driver and your information is processed through the Services on behalf of a carrier or broker, please direct your request to that carrier or broker, who is the controller of your information; we will assist them in responding to your request.

9. Children's Privacy

The Services are not intended for individuals under the age of 18. We do not knowingly collect personal information from children. If we become aware that we have collected personal information from a child, we will delete it.

10. International Users

AXON is based in the United States and the Services are operated from the United States. If you access the Services from outside the United States, your information will be transferred to and processed in the United States, where data protection laws may differ from those in your jurisdiction.

11. Changes to This Policy

We may update this Privacy Policy from time to time. We will post the updated policy on this page and revise the Effective Date at the top. Material changes will be communicated through the Services or by other reasonable means.
